Littlest Learners Terms of Service
1. Terms
By accessing the website at littlestlearners.com.au, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.
2. Use License
Permission is granted to download the materials (information or software) on Littlest Learners' website for personal and/or educational use only. This is the grant of a license, not a transfer of title, and under this license you may not:
modify the materials;
use the materials for any commercial purpose;
attempt to decompile or reverse engineer any documents on Littlest Learners' website;
remove any copyright or other proprietary notations from the materials; or
transfer the materials to another person or "mirror" the materials on any other server.
You will be contacted if you violate any of these restrictions and your account may be terminated by Littlest Learners. Upon terminating your account or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Further, Littlest Learners does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

In no event shall Littlest Learners or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Littlest Learners' website, even if Littlest Learners or an authorised representative has been notified orally or in writing of the possibility of such damage. The materials appearing on Littlest Learners' website could include technical, typographical, or photographic errors. Littlest Learners does not warrant that any of the materials on its website are accurate, complete or current. Littlest Learners may make changes to the materials contained on its website at any time without notice. However Littlest Learners does not make any commitment to update the materials.
6. Intellectual Property
All aspects of the Littlest Learners website and services is owned or controlled by Littlest Learners and TPB Productions. This includes, but is not limited to, all text, graphics, photographs, logos/trademarks, and other imagery and videos, user interfaces, computer code, and other content of our website. This also includes the design, structure, arrangement, expression, and the “look and feel” of the website. Littlest Learners' website is protected by copyright, trademarks, trade dress, trade secret, and other intellectual property rights.
You may not use, reproduce, copy, modify, republish, perform, display, disassemble, reverse engineer, translate, or distribute our website and it's assets in any way to any person, computer, server, website, or other entity for any commercial purpose without our explicit permission. By commercial purpose we mean that you can’t sell, license, rent, use in your own business or website, incorporate into marketing materials or presentations, or make other commercial use of our website assets.
The exception being promotional materials. We do encourage our customers to spread the word to colleagues, families, friends and other educational institutions whether this is electronically, verbally or using print materials. A promotional pack can be found on our About page with guidelines on using our brand.
7. Account
To use many aspects of our Services, you’ll be asked to create an account. Only individuals who are 18 years of age or older are eligible to create an account. By registering for an Account or using our Services, you represent and warrant that you are at least 18 years old.
When you create an Account, the information you provide needs to be true and accurate. Don’t provide fake or false information, don’t provide information that violates someone else’s rights, and don’t impersonate someone else.
We may ask for proof of your age or identity at any time in order to verify your Account and we may close or suspend access to your Account if you violate this rule or if we are unable to verify your age or identity.
If you’re a school, organisation, government, business, or other entity, the person whose email address is associated with the Account must have authority to bind the entity to this Agreement.
If your Account has been closed by Littlest Learners, you are no longer eligible to use our services.
You’ll be asked to pick a password to protect your Account. This password along with your email address is used to access your Account. It’s your responsibility to keep your login information confidential and you’re responsible for any and all activity that happens under your Account whether or not you authorised it. If you believe that your Account has been accessed by an unauthorised person, please contact us as quickly as possible at [email protected] so we can help.
You have the right to close your account at any time, without notice to us. You can close your Account by request to [email protected].
After your account is closed, you’ll no longer have access to your information, purchases, resources, and many of the features of our Services that require an Account.
8. Reviews
You have the option to provide reviews of any Resource by providing a rating and a comment. Any comment you choose to leave should reflect your honest experience using the Resource for its intended purpose and must comply with reasonable content. We may, at any time, set additional requirements or limitations for leaving comments such as a minimum or maximum characters, time-based restrictions, or other requirements. We may remove comments for any reason, at any time, without notice and we may ban an account from leaving future comments.
Reviews you have posted on the Littlest Learners website will not be removed if your Account is closed. You may request a review be removed by contacting us at [email protected].
9. Refund Policy
When you make a purchase on Littlest Learners, you agree to our this policy. All sales are considered final and nonrefundable once an order is submitted. We may, in our sole discretion, modify our policy or, on a case-by-case basis, issue a refund for a reason that falls outside of this policy.
Refund requests must be submitted within 30 days of your purchase and are granted on a case-by-case basis. For example:
A resource file is damaged or is missing content.
A thumbnail or preview is uploaded instead of the resource itself.
A resource preview and/or description misrepresents what is actually contained in the resource.
You are unable to access a resource because the technical requirements aren't included in the resource description.
You purchase the same resource twice.
You purchased the wrong resource for your class.
If your purchase meets these guidelines, you can email a refund request to us at [email protected]. As part of your request, be sure to include the resource name, your concerns about the resource, and any specific examples or details you might have.
10. Links
Littlest Learners has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Littlest Learners of the site. Use of any such linked website is at the user's own risk.
11. Modifications
Littlest Learners may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.
12. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of South Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
